The message came from Ábrego García's lawyers and was submitted to a federal judge on Wednesday.
Thus, his fate took a new turn in a prolonged development at a high political level.
Ábrego García has come to symbolize the Trump administration's tough migration policy. He was deprived of his freedom, expelled and placed in a high-security prison in El Salvador in March this year. The allegations against him were questioned, but once back in the USA, he was accused of human smuggling.
The 30-year-old Ábrego García, who is married to an American citizen, is now threatened with deportation to Uganda, which is said to have concluded a kind of migration agreement with the USA. He has said that he would rather be expelled to Costa Rica if he is forced to leave the USA, which can happen as early as October.
Ábrego García has been accused of belonging to the notorious criminal group MS-13, something he denies.
His lawyers pointed out in the asylum application that Ábrego García fears a summary trial and torture in Uganda.
